Petition rejected, Mirza Abbas corruption case will continue
The application seeking reconsideration of the judgment of the Appellate Division against BNP Standing Committee member and former Minister of Housing and Public Works Mirza Abbas for acquiring non-earned assets has been rejected.
The appellate bench headed by Chief Justice Hasan Faiz Siddiqui passed the order on Thursday (February 16). As a result, the lawyers said that there is no obstacle to continue the case against Mirza Abbas in the judicial court.
Lawyers Abdur Rezak Khan and Sagir Hossain Lyon were in favor of the application in the court. Md. lawyer was on behalf of the ACC. Khurshid Alam Khan. Khurshid Alam confirmed the order.
Earlier, on October 25, the Appellate Division dismissed the appeal against the High Court verdict. Later Mirza Abbas applied for review.
Sagir Hossain Lyon said that there was a case regarding income tax from 1990 to 2005. Mirza Abbas was convicted in that case. That sentence was overturned on appeal and he was acquitted. ACC filed a case on similar facts. We have said that the same case cannot be tried twice. But after the judicial court rejected the application, I applied to the High Court. After that, the application was also dismissed in the High Court Division. Later I applied to the Appellate Division. The Appellate Division dismissed the appeal.
Khurshid Alam Khan said that ACC Assistant Director Md. Shafiul Alam filed the case at Ramna police station on August 16, 2007.
On November 11, 2018, the High Court rejected the petition to quash the case. The case is currently at the stage of taking evidence in Dhaka's Special Judge Court 6.
