The High Court has given a verdict recognizing the mother as the guardian of the child in filling all the forms including SSC-HSC examination. Tuesday (January 24) Justice Naima Haider and Justice Md. The High Court bench consisting of Khairul Alam announced the verdict.

Advocate Ainunnahar Siddika, SM Rezaul Karim and Ayesha Akhter appeared for the writ in the court. On the other hand, Deputy Attorney General Amit Das Gupta appeared for the state.

Based on the information published in various newspapers in April 2007, the Rajshahi Education Board refused to give the admit card to a young girl of Thakurgaon to participate in the SSC examination because she could not fill the father's name in the student information form as required before participating in the secondary school certificate examination. It is to be noted that after the father's departure without giving any recognition to the mother and the child, the young woman was growing up with the sole love of her mother.

Later, on the basis of the information obtained on the proper investigation of this incident and the demand for the recognition of the mother as a child, on August 2, 2009, three human rights organizations - Bangladesh Legal Aid and Services Trust (BLAST), Bangladesh Mahila Parishad and Nari Paksha jointly filed a public interest writ.

On the preliminary hearing of the writ on August 3, 2009, the former High Court bench comprising of Justice Syed Refat Ahmed and Justice Mainul Islam Chowdhury ruled that why this discriminatory provision should not be declared unconstitutional and contrary to human rights, equality and especially the right to education. At the same time, at present in any education board, in order to get the registration card of SSC exam, it is mandatory to mention the correct information of the name of both the father and mother of the student, a list of them and what kind of arrangements are made in participating in the examination for those eligible students who are unable to mention the identity of their father. The report is directed to be submitted.

Later on 6 June 2021 Blast filed a supplementary affidavit on behalf of the petitioners.
