The Appellate Division has finally given two months time to prepare the summary of the appeal against the High Court's verdict that the Election Commission's registration given to Bangladesh Jamaat-e-Islami as a party is invalid.

The Appellate Division has finally given two months time to prepare the summary of the appeal against the High Court's verdict that the Election Commission's registration given to Bangladesh Jamaat-e-Islami as a party is invalid.

A three-judge appellate bench headed by Chief Justice Hasan Faiz Siddiqui passed the order on Tuesday (January 31).

Advocate on record Zainul Abedin Tuhin stood for the Jamaat in the court. Barrister Tanya Amir appeared for the writ petitioner.

Hearing of the case

  • Later, barrister Tanya Amir said, we have taken many initiatives to hear the case. The court gave them time many times. They are not preparing in vain. Final order given today. If the file (summary of appeal) is not ready for hearing within eight weeks, it will be defaulted (dismissed).
    Meanwhile, Matiur Rahman Akand, a lawyer of Jamaat-e-Islami, said that it was on the agenda of the Appellate Division today. The court gave time for the next two months. Directed to submit Concise Statement within two months. He mentioned that he would not give any more time.

He said that according to the order of the court, Jamaat-e-Islami will participate in the hearing of the case. I hope Jamaat will get its registration back. I can prepare it in two months. Our lead lawyer is former Attorney General AJ Mohammad Ali. Barristers Imran Siddique and Ehsan Siddique are also employed as advocates. They will handle this case.

After issuing the rule on registration of Jamaat, they amended their constitution once in December of that year, twice in July and November of 2010 and twice in October and November of 2012 and submitted it to the Election Commission. In these amendments, the name of the party was changed from 'Jamaate-e-Islami, Bangladesh' to 'Bangladesh Jamaate-e-Islami'.
