Application seeking ban on GM Quader's performance of duties
Jatiya Party's former member of parliament Ziaul Haque Mridha through his lawyer Helal Uddin filed this application in the Supreme Court yesterday. Mridha's chief lawyer Mohammad Syed Ahmed Reza told The Daily Star that the Appellate Division's chamber judge may hear the application next Sunday.
Lawyer Helal Uddin said that the application was filed in the Chamber Court of the Appellate Division on Thursday (February 9). He said, next Sunday (February 12) the hearing on this application may be held in the chamber court.
Earlier on February 5, the High Court suspended the lower court's ruling that Ghulam Mohammad (GM) cannot perform his duties as Jatiya Party chairman as per the constitution. As a result, there is no hindrance to GM Quader's duties as JAPA chairman, his lawyer said.
Justice Md. A single High Court bench of Abdul Hafeez passed the order.
Advocate Sheikh Muhammad Sirajul Islam appeared on behalf of GM Quader in the court.
On January 19, the District Judge Court dismissed the appeal against the order banning Golam Mohammad (GM) from performing his duties as the chairman of the Jatiya Party according to the constitution.
Later, GM Quader appealed to the Appellate Division against this order.
Earlier on January 13, the Appellate Division ordered that Golam Mohammad (GM) cannot perform his duties as the chairman of Jatiya Party according to the constitution. At the same time, the Supreme Court ordered the settlement of the case in the lower court in this regard by January 9.
On November 29, the High Court suspended the order prohibiting Golam Mohammad (GM) Quader from performing his duties as Jatiya Party chairman as per the constitution. The court also issued a ruling.
A single High Court bench of Justice Sheikh Abdul Awal gave the order. Later an application was filed seeking stay of this order.
Former MP Ziaul Haque Mridha, who was expelled from Japa on October 4, filed a case seeking a ban on Golam Mohammad (GM) Quader's duties as chairman of Jatiya Party. In view of the plaintiff's application, on October 31, the First Joint District Judge Court of Dhaka issued a temporary order banning GM Quader's party activities as chairman of Jatiya Party.
Later, several lawyers including Sheikh Sirajul Islam, Kalim Ullah Majumdar filed this application on behalf of GM Quader. The petition sought the withdrawal of the ban order on Jatiya Party chairman Ghulam Mohammad (GM) Quader from serving as party chairman as per the constitution. On November 24, a miss appeal was filed in the district judge's court for hearing this application. The district judge rejected that application. GM Quader filed a revision petition in the High Court against the order of the District Judge Court.
According to the case, Jatiya Party founder former president Hussain Muhammad Ershad died on September 14, 2019. After that, the defendant GM Quader announced himself as the chairman in the council on December 28 that year through forgery despite a writ case pending in the High Court Division.
In the case of Ziaul Haque Mridha, it is said that on March 5, Gazipur metropolitan committee advisor Ataur Rahman Sarkar, organizing secretary Sabur Shikder, freedom fighter affairs Rafiqul Islam and central committee member Dr. Md. Aziz expelled. Besides, on September 14, plaintiff Moshiur Rahman expelled Ranga from the post of presidium member of Jatiya Party. On the other hand, on September 17, Advocate Ziaul Haque also expelled Mridha from the Jatiya Party, which is illegal.
Therefore, an order has been sought in the case to declare the expulsion order invalid until 17 September this year including the council of 28 December 2019 and to suspend the next council of the Jatiya Party until the High Court Division Writ 15051/2019 is disposed of.
