GM Quader is not barred from performing his duties as chairman: High Court

The High Court has suspended the ban order of Ghulam Mohammad Quader (GM Quader) as Chairman of Jatiya Party (Japa). With that, the judgment of the lower court has been suspended.

A single bench of Justice Sheikh Abdul Awal passed the order on Sunday (February 5).

As a result, GM Quader's duties as Jatiya Party chairman are no longer hindered, his lawyers said. Lawyer Sheikh Muhammad Sirajul Islam heard on behalf of GM Quader.

Earlier, on October 4, Ziaul Haque Mridha, who was expelled from Japa, filed a case against GM Quader. In the same court, Mosiur Rahman Ranga filed another case against four people including GM Quader on October 3.

It is said that Advocate Ziaul Haque also expelled Mridha from the Jatiya Party on September 17, which is completely illegal. Therefore, an order is sought in the case to declare the expulsion order invalid till September 17 this year, including the council of December 28, 2019, and to suspend the next council of the Jatiya Party until the writ of the High Court Division is disposed of.

On October 6, Sheikh Sirajul Islam, Kalim Uliah Majumdar and several other lawyers filed this application on behalf of the Jatiya Party. The petition sought revocation of the ban order on GM Quader from serving as the chairman of the party as per the constitution.

According to the case report, Jatiya Party founder former president Hussain Muhammad Ershad died on September 14, 2019. After that, the defendant GM Quader declared himself the chairman of the Council on December 28 of that year, even though a writ case was pending in the High Court Division.
