BNP's 27-point outline on 'repairing' the state structure

BNP has announced a 27-point outline to repair the state structure. Outline of state structure repair against unelected authoritarian regime from BNP side. This outline has been prepared in the light of 19 points declared by President Ziaur Rahman and Vision-2030 of BNP declared by Begum Khaleda Zia.

The clauses are-

1. Over the last decade, the Awami League has introduced many unreasonable fundamental constitutional amendments with the trivial purpose of maintaining power. A 'Constitutional Reforms Commission' will be formed to review controversial and undemocratic constitutional amendments and changes to repeal/amend them and carry out other essential constitutional reforms. The democratic authority of the people will be restored by reintroducing the referendum system in the constitution.

2. 1 inclusive, non-discriminatory and harmonious state will be established on the basis of Bangladeshi nationalism, encompassing all views and paths, against the politics of revenge and revenge. Therefore, on the basis of continuous discussion, exchange of ideas and mutual understanding, a new type of social contract should be reached towards the future. For this, 1 'National Reconciliation Commission' will be formed.

3. A 'Non-Party Caretaker Government' system will be introduced in Bangladesh with the aim of restoring democracy and suffrage and giving permanent constitutional and institutional form to the transparent democratic process.

4. Article 70 of the Constitution will be amended to ensure the freedom of expression of opinion of the members of Parliament on money bills, confidence votes, questions of internal security and other than constitutional amendment bills.

5. The executive powers of the President of the Republic and the Prime Minister of the State will be balanced. The powers, responsibilities and duties of the Executive, Legislative and Judiciary will be harmonized with a view to establishing a balance of domestic powers.

6. In addition to the parliamentary system, a 'Bi-cameral Legislature' will be introduced comprising of eminent academicians, professionals, political scientists, sociologists and people with administrative experience in order to manage the country with the combination of expert knowledge.

7. The modern 'Election Commission Appointment Act' will be reformed with the aim of forming an effective Election Commission consisting of independent, efficient, neutral, acceptable and determined people based on the opinions of political parties and eminent persons. Voting will be ensured by paper-ballot at the center and not by EVMs. RPO, Delimitation Order and Political Party Registration Act will be reformed. The use of party symbols in local government elections will be abolished.

8. The institution will be restructured to rise above narrow political partisanship and restore transparency, accountability and credibility in all state, constitutional and statutory institutions. Appointments to these institutions will be subject to vetting by parliamentary committees through hearings.

9. Effective independence of the judiciary will be ensured in the light of the Constitution of Bangladesh and the judgment of the Masdar Hossain case. A 'Judicial Commission' will be constituted to reform the present judicial system. Page 2 Page 2 The regulation, transfer, promotion, retirement and job discipline of Judicial Magistrates will be administered by the Supreme Court. There will be 1 separate secretariat under the control of the Supreme Court for the Judiciary. The erstwhile 'Supreme Judicial Council' arrangement mentioned in the Constitution will be reinstated on the question of impeachment of Supreme Court judges. For this, necessary amendments will be brought in the constitution. Judges will be appointed only on the basis of strict criteria of knowledge, wisdom, ethics, judgment and reputation, above partisan considerations. With the aim of appointing the judges of the favorite court, the 'Judge Appointment Act' will be framed as per 95(c) of the Constitution with specific qualifications and criteria.

10. The administration will be restructured by constituting an 'Administrative Reforms Commission' consisting of qualified and experienced persons with a view to impart patriotic service, public administration and police administration. Merit, integrity, creativity, competence, experience and training will be settled as the sole criteria of eligibility for recruitment, transfer and promotion in civil and military administration.

11. A 'Media Commission' headed by a former judge of the beloved court will be constituted for comprehensive reforms. An environment of honest journalism will be restored and all journalist harassment and murders including the sensational Sagar-Rooney murder will be prosecuted.

12. There will be no compromise in cases of corruption. A white paper will be published and legal action will be taken against those responsible identified in the white paper, looking into organized money-laundering and corruption over the past decade and a half. Necessary administrative and legal measures will be put in place to repatriate money laundered outside the country. Transparency and accountability will be ensured by reforming the Anti-Corruption Commission and Prevention of Corruption Act as well as procedural reforms. According to the constitution, the 'ombudsman' will be appointed.

13. Establishing the rule of law at all levels will restore human values and human dignity and end disappearances, murders, extrajudicial killings and inhumane cruel physical and mental torture. According to the 'Universal Charter of Human Rights'
